Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 504, 353, 506/34, 272, 273 of the Indian Penal Code and Section 30(a), 45 of the Bihar Prohibition and Excise Act, 2016. Prosecution case is that 200ml illicit desi chulai liquor was recovered from the house of co-accused Bhagwan Mahto @ Gabbar Mahto.

Learned counsel appearing for the petitioners submits that the petitioner is innocent and have falsely been implicated

Patna High Court CR. MISC. No.6694 of 2023(3) dt.24-04-2023 2/2 in this case. No incriminating material has been recovered from the conscious possession of the petitioner and they are no way connected with the aforesaid recovery. Petitioners claim criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. II, Muzaffarpur, in connection with Sahebganj Police Station Case No. 158 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
