The petitioner is accused in connection with Gwalpara P.S. Case No. 73 of 2014, registered under Section 392 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner has been disclosed by co-accused Rupesh Pathak in his confessional statement showing his involvement and involvement of the petitioner in the present occurrence. Further submission is that the petitioner having no criminal antecedent is in custody since 22.12.2014, but he has not been put on T.I.P for identification while physic has been detailed in the F.I.R.
