The petitioner seeks bail in Shahkund ( Sajour ) P.S. case no. 188 of 2018 instituted for the offence under Sections 365/34 of the IPC. Later on, Sections 302 and 201 of the I.P.C. was added.

Learned counsel for petitioner submits that informant has raised mere suspicion against this petitioner. Petitioner has clean antecedent.

In the written report, it is alleged that one Laxman Mandal @ Nikku called the Mama of the informant by telephone and thereafter he did not return to his house. Thereafter search was made by the informant and in course of

No.3667 of 2019(2) dt.30-01-2019 2/2 search informant gathered information that Laxman Mndal @ Nikku along with other accused persons including this petitioner have conspired and done something unpleasant with this petitioner. The cause of occurrence is alleged to be dispute regarding Shobha Pokhar. Subsequently, on the basis of the news item published in daily news paper Prabhat Khabar the dead body was recovered.

Learned counsel for petitioner submits that police recorded confessional statement of co- accused Laxman Kumar (Laxman Mandal) and Dharmendra Kumar @ Badal Kumar and they disclosed the name of this petitioner before the police. Petitioner is in custody since 26.8.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Bhagalpur, in connection with Shahkund ( Sajour ) P.S. case no. 188 of 2018 , G.R. No. 4643 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
