The petitioner seeks bail in Khaira P.S. Case No.303 of 2018, instituted for the offence under Section(s) 379 and 461 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is in custody since 1.12.2018 having clean antecedent. Charge has been framed in this case. Counsel for the petitioner further submits that petitioner is not named in the written report. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of coaccused. It is mentioned in the seizure list that stolen Mobile has been recovered from the house of this petitioner. There is
Patna High Court Cr.Misc. No.1093 of 2019(3) dt.07-02-2019 2/2 no recovery from conscious possession of the petitioner. The police took signature of the petitioner on the seizure list by force.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Xth, Saran at Chapra, in connection with Khaira P.S.
