Mr. Sanjay Kumar Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Jandaha P. S. Case No. 122 of 2017 registered for the offence punishable under Section 392 of IPC.

As per prosecution case some miscreants on Scorpio overtake the informant and assaulted him by bat portion of the pistol and snatched Rs.1,00,500/- and a golden chain and other articles.

Submission of the learned counsel for the petitioner is that he is not named in the F.I.R. Except the confessional statement of the co-accused, there is nothing against him. Considering the same, two other accused, whose names also transpires on the confessional statement of the co-accused, have been granted bail by a Co-ordinate Bench of this Court, vide order dated 27.09.2019 passed in Criminal Misc. No. 43048 of

Patna High Court CR. MISC. No.1662 of 2020(2) dt.14-01-2020 2/2 2019. Further submission is that he is in custody for about five months. Charge sheet has already been submitted, but he has not been put on TIP.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground of criminal antecedent of the petitioner. Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., Vaishali, at Hajipur, in connection with Jandaha P. S. Case No. 122 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
