Admittedly, petitioners Nos. 1 &2 are brother-in-law and mother-in-law of the deceased respectively. It is also an admitted position that originally, the case was registered under Sections-498A, 494, 304(B) of the Indian Penal Code but after investigation, police submitted charge sheet u/S 302 of the Indian Penal Code.
Taking note of the aforesaid facts as well as this aspect of the matter, that no specific overt act has been attributed against them, let petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Piprakothi P.S.
Patna High Court Cr.Misc. No.3271 of 2015 (2) dt.27-01-2015 Case No. 53 of 2014 to the satisfaction of Judicial Magistrate-ist Class, Motihari, East Champaran.
