Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 341, 324, 307 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in brief, is that the accused persons opened fire with country-made pistol as a result of which, the informant sustained fire-arm injury on his back. It has been submitted on behalf of the petitioner that there

Patna High Court CR. MISC. No.4893 of 2019(3) dt.11-04-2019 2/2 is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 16-11-2017. The petitioner has been falsely implicated in the present case. There is a land dispute between the parties. Single fire shot is alleged to have been made. No repetition is said to have been made. The petitioner has remained in custody for more than one and a half year.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Jehanabad in connection with Sessions Trial No. 201 of 2018/130 of 2018 arising out of Jehanabad (Kalpa) P.S. Case No. 779 of 2017.
