The challenge in the instant writ petition is to the Enquiry Report dated 28.12.2018 as well as the order of punishment dated 09.08.2019, whereby the petitioner has been dismissed from service.
The admitted position is that the petitioner has availed her remedy under Rule 24(2) of the Bihar Government Servants (Classification, Control & Appeal) Rules, 2005 ( for short 'the
Patna High Court CWJC No.2369 of 2020(2) dt.24-02-2020 2/2 Rules'). The specific averments, to this effect, has been made in paragraph No 20 of the writ petition. Since the same is pending adjudication/ disposal, the writ petition has premature. The petitioner would be at liberty to approach this Court after disposal of the same.
