The petitioner seeks bail in connection with Special Case No. 5705 of 2021 arising out of P.R. Agamkuan Case No. D-35 of 2021 instituted for the offences under Sections 30(a), 32(1), 32(3), 41(1) and 41(2) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 13.09.2021, prosecution report has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the allegation is of recovery of 100 litres of liquor from a motorcycle.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.4556 of 2022(2) dt.07-03-2022 2/2 petitioner was standing near the motorcycle and came to be implicated when the search was made. It is submitted that the said motorcycle does not belong to the petitioner. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 5705 of 2021 arising out of P.R.
