The petitioner is languishing in custody in a case registered for the offences punishable under Sections 365, 366(A) of the Indian Penal Code. It is alleged by the informant that minor daughter of the informant was kidnapped by unknown accused persons for marriage purposes.

The petitioner is not named in the F.I.R and his name subsequently sprang up during the course of investigation. For the alleged occurrence of 14.07.2022, the F.I.R was registered on 19.07.2022 without explaining the delay. The medical board opined the age of the victim between 18-19 years. The victim in her 164 Cr.P.C statement though stated that she stayed in the house of the petitioner but she did not allege any physical or sexual assault against the petitioner and told that she of her own volition, went in the house of the petitioner. The victim was known to the petitioner since the petitioner was friend of her father and teaching in his house. The petitioner is languishing in custody since 24.07.2022.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.
