The petitioner seeks bail in Darpa P.S. Case No. 59 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

Manoj Kumar Patel named eight persons in the FIR and alleged that all the accused persons having armed with different weapons came and forcibly tried to construct house on Plot No. 2136, Khata No. 18. On protest, the petitioner is alleged to have assaulted Rammati Devi with Pharsa.

Learned counsel for the petitioner submits that the petitioner is not alleged to have assaulted any other person nor has given any second blow to Rammati Devi. Rammati Devi got simple injuries on her palm. There is counter version as well.

Patna High Court Cr.Misc. No.4300 of 2015 (2) dt.02-02-2015 Having considered the facts that on account of land dispute the occurrence took place, the petitioner is alleged to have assaulted with sword to Rammati Devi and Rammati Devi got simple injury on her palm, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri K.
