The petitioner seeks pre-arrest bail in connection with Rahui P.S. Case No. 186 of 2013 registered under Sections 304-B, 201 and 316 read with 34 of the Indian Penal Code. Regard being had to the fact that after completion of investigation the police had submitted final report bearing No. 168 of 2013 dated 30.11.2013 along with the case diary wherein the investigating officer had arrived at a conclusion that the accused persons were liable only for non-cognizable offence under Section 176 of the Indian Penal Code and the accused

No.12078 of 2016 (2) dt.17-03-2016 2 / 2 persons were exonerated from Section 304-B and other allied sections of the Indian Penal Code by mentioning that the deceased Ruby Devi died due to pregnancy on the way to Patna for treatment, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rahui P.S. Case No. 186 of 2013 subject to the conditions as laid down under Section 438(2) Cr. P.C.
