This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Amaur P.S. Case No.154 of 2023 registered for the offence under Sections 8(c), 21 (b), 25 and 29 of the NDPS Act.

Earlier, the bail application of the petitioner has been rejected vide order dated 02.08.2023 passed in Criminal Miscellaneous No.47807 of 2023.

The recovery is of 9.94 grams of brown sugar and a motorcycle from the petitioner.

The petitioner is in custody since 17.05.2023.

Considering the recovery of intermittent

Patna High Court CR. MISC. No.9333 of 2024(2) dt.23-02-2024 2/2 quantity of brown sugar and also considering the period of custody of the petitioner, this application is allowed. 7.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea, in connection with Amaur P.S. Case No.154 of 2023.

This is subject to the condition that petitioner shall mark his attendance in Raniganj Police Station, DistrictNew Jalpaiguri (West Bengal) on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. 9.
