Heard learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 147, 148, 149, 341, 323, 302 of the Indian Penal Code, registered in connection with Lakhnaur (R.S.O.P.) P.S. Case No. 74 of 2021. As per FIR, when the petitioner Sunita Devi was grazing her cow, the informant's wife Nirmala Devi(deceased) prohibited her, on which the petitioner called her family members namely Sanjiv Kamat, Anil Kamat, daughter of Bechan Kamat, wife of Bechan Kamat, nephew of Bechan Kamat and 8-10 other members of the family of Bechan Kamat and badly assaulted the informant's wife due

Patna High Court CR. MISC. No.4582 of 2022(2) dt.31-05-2022 2/2 to which she died.

The learned counsel for the petitioner has submitted that petitioner is a lady and she has no criminal antecedent. She is under custody since 10.08.2021.

Learned APP for the State opposes the prayer and submits that as per the FIR, the petitioner assaulted the deceased. Considering the above facts and circumstances as well as the period of detention and also that she is a lady, let the petitioner above-named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Jhanjharpur, in connection with Lakhnaur (R.S.O.P.) P.S. Case No. 74 of 2021.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
