2. The petitioners apprehend arrest in connection with Harsidhi P.S. Case No. 255 of 2024, registered under Sections 147, 149, 323, 307, 354B, 379, 504 and 506 of the Indian Penal Code.
3. The prosecution case, in short, is that, co-accused persons, namely Sonu Kumar and Sandip Kumar using kulhari and farsa assaulted the informant due to which she sustained injuries on her head.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the
Patna High Court CR. MISC. No.6273 of 2025(2) dt.31-01-2025 2/3 present case. Learned counsel for the petitioners also submits that both the parties are neighbour and there is land dispute between them and due to the said reason, the petitioners have been falsely implicated in this case. Specific allegation of assault has been attributed against co-accused, namely, Sonu Kumar and Sandip Kumar. It is further submitted that there is case and counter case between the parties. As per injury report, the injuries sustained by the informant are found to be simple in nature. The petitioners have got no criminal antecedent. Learned counsel for the petitioners further submits that similarly situated co-accused has been granted regular bail by this Court vide order dated 24.07.2024 passed in Cr. Misc. No. 49020 of 2024.
5. Learned APP for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts and circumstances, let the petitioners, above named in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Harsidhi P.S. Case No. 255 of 2024, subject to the conditions as laid down under
