JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 29.02.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner was intercepted by the police officials in routine vehicles check-up and when he was asked to produce relevant documents of his vehicle, he produced some documents which were found forged.

Moreover, according to the prosecution case itself, petitioner disclosed before the informant that he had purchased the aforesaid motorcycle from the person who did not hand over relevant documents of the aforesaid vehicle.

Learned counsel appearing for the petitioner submitted that, as a matter of fact, nothing was recovered from possession of the petitioner nor he was caught with the seized motorcycle but subsequently, he was implicated in this case by the police. To fortify the above stated contention, he drew my attention towards photocopy

Patna High Court Cr.Misc. No.8727 of 2016 (2) dt.29-02-2016 of the seizure list and submitted that seizure list does not bear the police station case number.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Sonepur P.S. Case no. 473/2015.
