The petitioner seeks bail in Sherghati P.S. Case No. 164 of 2019, registered for the offence punishable under Sections 341, 323, 504, 387, 34 of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence, three persons came on motorcycle, started assaulting the labourers working on Nirachala River and threatened them to stop work and also demanded extortion. It is submitted on behalf of the petitioner that petitioner is not named in the FIR and he has been made accused in this case only because of his criminal antecedent.
