The petitioner is apprehending his arrest in a case registered under Sections 406 & 409 of the Indian Penal Code. The prosecution case, in brief, is that the accused persons committed irregularity in the work of UIDSSMT road scheme of Nagar Panchayat, Chaikya during the period from April 2009 to November 2009.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a government employee. The occurrence is of the year, 2009. The petitioner was given the additional charge of Nagar Panchayat, Chakiya in the year, 2012. He had no concern

Patna High Court Cr.Misc. No.4996 of 2019(2) dt.30-01-2019 2/2 with the work which was carried out in respect of Nagar Panchayat, Raxaul. No specific irregularity has been pointed out by the prosecution in respect of work, carried out under the Nagar Panchayat.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-13, Motihari, East Champaran in connection with Chakiya P.S. Case No. 135 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
