In this case, the petitioner is seeking regular bail in connection with Araria (Bairgachhi) P.S. Case No.346 of 2015, registered for the offences punishable under Section 392 of the Indian Penal Code.

Allegation has been made that on 15.07.2015 while the information was going by his motorcycle three persons intercepted him and forcefully took away Rs.39,000/-.

The name of the petitioner has come in the confessional statement of co-accused-Ashif. No any incriminating material was recovered from the possession of the petitioner. Having considered

Patna High Court Cr.Misc. No.8029 of 2016 (4) dt.28-04-2016 2/3 the aforesaid facts, let the petitioner-Md. Sadaquat @ Sadaquat be released on 6th June, 2016 on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria, in connection with Araria (Bairgachhi) P.S. Case No.346 of 2015 subject to the conditions that:- (i) one of the bailors will be a close relative of the petitioner;

(ii) if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to make prayer for cancellation of his bail and the Court below will pass necessary order, including cancellation of bail;

(iii) that the petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to cancel the bail bonds of the petitioner;

(iv) The petitioner shall mark his presence to the nearest police station before 7th of every month till six months and;

(v) The Court below will verify the criminal antecedent mentioned in paragraph No.3 of the

Patna High Court Cr.Misc. No.8029 of 2016 (4) dt.28-04-2016 3/3 bail application and if variation is there, the trial Court will refuse to grant bail.
