The petitioner is languishing in custody since 10.10.2014 in a case registered for the offences punishable under Sections 341, 323, 395 and 506 of the Indian Penal Code. The accusation is of robbing a truck. Three persons were apprehended with the truck near the place of occurrence, who named this petitioner.

It is submitted by learned counsel for the petitioner that he has been named because apprehended persons are co-villagers of the petitioner and consequently the petitioner surrendered before the learned court below. There is no recovery from the petitioner nor the petitioner has been put on TIP.

Patna High Court Cr.Misc. No.3600 of 2015 (02) dt.28-01-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Agiaon (Garahani) P.S. Case No. 106 of 2014.
