JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 302 & other minor sections of the Indian Penal Code and under Section-27 of the Arms Act.

Petitioner appears to be main assailant and his prayer for bail has already been rejected by this court vide order dated 02-02-2015 passed in Cr. Misc. No. 3919 of 2015. Submission on behalf of petitioner is that petitioner is suffering from illness and, therefore, he needs some specialized treatment, for which, he should be released on bail, provisionally, but I am not, at all, convinced with the aforesaid submission and, accordingly, his prayer for bail in connection with Kotwa P.S.

Patna High Court Cr.Misc. No.7775 of 2016 (2) dt.11-05-2016 2/2 Case No. 120 of 2014 pending in the court of learned Chief Judicial Magistrate, Motihari, East Champaran is, again rejected. However, if, petitioner needs some special treatment, he may move before the trial court for the same and, if, petitioner does so, the trial court shall direct the jail authorities to take proper steps for treatment of the petitioner.
