The petitioner apprehends his arrest in connection with Mithanpura P.S. Case No. 271 of 2022 registered under Section 387/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The first information report is lodged after lapse of one month of the alleged occurrence. Further he submits that Anexure-2 shows that at the time of execution of agreement, the petitioner has given 51,000/- as advance to the informant. Out of total consideration amount of Rs. 50 Lacs, the petitioner and his two partners paid Rs.

No.3771 of 2023(2) dt.20-02-2023 2/2 44,01,000/-, but the informant was not ready to execute the sale deed even after giving balance consideration amount, as contained in Annexure-3 to the bail application. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Muzaffarpur (East) in connection with Mithanpura P.S. Case No. 271 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
