JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-07-2022 Though, the present writ petition has been filed seeking payment of death-cum- retirement benefit to the petitioner in lieu of death in harness of her alleged husband namely late Anil Kumar Anal, while he was posted as Junior Engineer in the P.W.D. Department, Saharsa, on 01.02.1999 but on account of anomalies pointed out by the Respondent State in the counter affidavit filed in the present case to the effect that the deceased employee had mentioned the name of his wife as Sujata Devi in the papers/ documents submitted before the Respondent State at the time of submitting his joining on

Patna High Court CWJC No.1019 of 2022(3) dt.28-07-2022 2/2 1.2.1999 whereas the date of birth of the petitioner, whose name is also different, which in fact is Sujata Kumari Pinki Devi, is stated to be 5.6.1994, resultantly the petitioner being only five years old at the time deceased employee had submitted his joining in the services of the State Government, which also makes the alleged story of the petitioner being wife of late Anil Kumar Anal improbale, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty to avail such other remedies as are available in law. Liberty so sought is granted.
