JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Neither petitioners were caught on the spot nor anything has been recovered from their conscious possession and according to prosecution case itself, the alleged recovery of country made and foreign liquor was made from the shop of one Birendra Singh. Although, it is stated that aforesaid Birendra Singh had given the shop in question on rent but there is nothing on record to show who had taken the aforesaid shop on rent. Moreover, petitioners do not have any criminal antecedent and are languishing in jail custody since 07.12.2015. Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.7460 of 2016 (2) dt.17-02-2016 2/2 well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with N.T.P.C. Khaira P.S. Case No. 28 of 2015.
