The petitioner seeks bail in connection with Sugauli P.S. Case No. 486 of 2019, registered for offence punishable under Section 376 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that from perusal of the FIR, it appears that the informant is married woman having two child, she came in contact with the present petitioner and with consent or with her sweet will, she made physical relationship with the petitioner. The petitioner has no criminal antecedent and he is in custody since 08.11.2019. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.1597 of 2020(2) dt.23-01-2020 2/2 and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S. Case No. 486 of 2019.
