JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner as well as learned APP for the State.
There was dacoity in the house of informant, Mahesh Choudhary wherein the articles so enlisted therein, were taken away by the unknown dacoits. Accordingly, an FIR was registered against unknown persons.
As is evident from para-34 of the case diary, on getting confidential information, police conducted raid and during course thereof, so many persons were apprehended who were staying in a tent having been fixed in the orchard of Ram Kishore Bhagat. It is further evident therefrom along with para-35, copy of seizure list that from the tent belonging to the petitioner different articles as enumerated therein have been recovered.
However, from the certified copy of the seizure list, it is evident that at Column No.3, it has been incorporated that
Patna High Court Cr.Misc. No.8619 of 2016 (3) dt.12-04-2016 recovery was made from the tent belonging to petitioner Baliram Baidh, however, LTI of all the arrested persons including petitioner have been taken and on account thereof, it looks difficult to encircle the petitioner exclusively relating to recovery shown under the seizure list.
Accordingly, petitioner, Baliram Baidh @ Baliram Baidya is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur PS Case No. 938/2015.
