The petitioner, who is husband of informant, is in custody in connection with Bihta P.S. Case No. 981 of 2017 for the offence under Sections 498A, 494, 341, 323, 504/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 15.11.2019. He further submits that the petitioner is ready to keep his wife with full dignity and honour, but the wife is not willing to stay with the petitioner. He further submits that the petitioner is ready to pay Rs. 7500/- per months to his wife (informant), as maintenance.

No.5766 of 2020(5) dt.02-07-2020 2/2 Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P.S. Case No. 981 of 2017 with the condition that the petitioner will make payment of Rs.7500/- per month to his wife (informant) regularly, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
