In this case the petitioner is seeking bail in connection with Siwan Town P.S. Case No. 651 of 2015 for offence under Section 363 of the Indian Penal Code which was subsequently converted into Section 364(A) of the Indian Penal Code. First Information Report has been lodged by the Branch Manager of ICICI Bank stating that the present petitioner had gone outside in connection with the work of Bank but, he did not return and, thereafter, he has given a call to the elder brother of the petitioner who informed that the petitioner had not reached to his house.
A ransom amount was demanded from the father of the
Patna High Court Cr.Misc. No.7484 of 2016 (3) dt.12-04-2016 petitioner for release of the present petitioner and later on the police in course of investigation found that it is the petitioner who hatched a conspiracy and projected himself to have been kidnapped by criminal, demanded ransom amount and ultimately the petitioner was arrested by the police.
Learned counsel for the petitioner has submitted that the father has not been examined by the police but, the present application has been affidavited by the father of the petitioner and nowhere in the petition it has been stated that ransom amount was demanded from him. It is nothing but a cheating the father. Looking to the facts and circumstances of the case, let the petitioner, namely, Murlidhar Krishna, be released on bail on 16th of May, 2016 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S.
