The petitioner seeks bail in anticipation of his arrest in connection with Desri P.S. Case No. 298 of 2019, dated 28.08.2019, instituted for the offence under Section 395 of the Indian Penal Code.

The petitioner has not been named in the F.I.R. and his implication in the instant case is only on the basis of confession of a co-accused person, namely, Ritesh Kumar,

The petitioner earlier was made accused in a case vide Desri P.S. Case No. 108 of 2017, but he has been granted anticipatory bail in the aforesaid case. Some of the other similarly situated accused persons of this case have been granted anticipatory bail by different Benches of this Court.

Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Desri P.S. Case No. 298 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
