JUSTICE SHIVAJI PANDEY ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In this case the petitioner is seeking bail in Korha P.S. Case No.195/15 for the offence under Section 304(B) of I.P.C.

The petitioner is the husband and the wife died on account of his severe torturing and assault.

The allegation has been made by the informant that the petitioner had administered the poison to his wife but during the investigation it transpired that the witnesses consistently have stated that the petitioner used to assault the victim for bringing money from her parents. Some money was also given to him, though he was not satisfied with the same. Panchayati was also

Patna High Court Cr.Misc. No.7429 of 2016 (3) dt.11-04-2016 2/2 called. On account of torturing the victim had consumed the poison.

In such view of the matter, this Court is not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected.
