09.03.2016 Heard learned counsel for the Petitioner and the State.

The Petitioner seeks bail in a case instituted for the offences under Sections 147, 148,149, 341, 323, 447 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted that the trial is still not concluded and the Petitioner undertakes to be physically present on each date.

Be that as it may, let the Petitioner, above named be released on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each or any other surety as fixed by the Court to the satisfaction of Ad hoc Additional Sessions Judge-V, Siwan in connection with S.Tr. No. 208/2011/133/2013 arising out of Maharajganj P.S. Case No. 94 of 2009 subject to the

Patna High Court Cr.Misc. No.4141 of 2015 (5) dt.09-03-2016 following conditions:- (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner and the other bailor shall be the son-in-law (Damad) of the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner. (ii) That the Petitioner will be physically present on each date of trial and if he fails to do so on two consecutive dates without reasonable cause, his bail shall stand automatically cancelled.
