The petitioner is languishing in custody since 20.12.2014 in connection with Sessions Trial No. 131 of 2015, arising out of Atri P.S. Case No. 29 of 2014 for the offences instituted under Sections 147, 148, 149, 302, 120(B) of the IPC and 27 of the Arms Act.

It is alleged that this petitioner has committed murder of the informant's husband.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application. This is second attempt on behalf of the petitioner for grant of bail. A report was called for from the court below regarding

Patna High Court Cr.Misc. No.10342 of 2016 (4) dt.05-09-2016 2/2 the stage of the case. The same is at Flag-'A'. It has been reported that out of 12 charge sheeted witnesses, 07 witnesses have already been examined on behalf of the prosecution.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Sessions Trial No. 131 of 2015, arising out of Atri P.S. Case No. 29 of 2014, pending in the court of the learned A.D.J. Vth, Gaya. The court below is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of copy of the order. The District Magistrate, Gaya, and the Superintendent of Police, Gaya, are also directed to ensure that all prosecution witnesses are produced on the date fixed by the court below so that the trial could be concluded.
