Petitioner is named in the first information report but there is only allegation against him that he along with other FIR named accused had taken wine in extortion from wine shop but according to prosecution case itself, petitioner does not appear to have participated in the present occurrence. Moreover, the petitioner and the informant are co-villagers and the informant has nowhere stated about the participation of the petitioner in the assault.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner
