The petitioner is accused in connection with Jogbani P.S. Case No. 113 of 2015 registered under Sections 25(1-B)A, 26 and 35 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not the owner of the bicycle, in which, the bag was found wherein two guns, one pistol and three live cartridges were recovered. In fact, the petitioner was going to Railway Station on taking lift from the said bicycle but on seeing police personnel of S.S.B., owner of the bicycle succeeded to flee away and this petitioner was apprehended by the police on the spot. Patna High Court Cr.Misc. No.9136 of 2016 (2) dt.28-03-2016 submitted that petitioner has no criminal antecedent and is in custody since 23.12.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Araria, in connection with Jogbani P.S.
