JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 11.05.2015 on the accusation that looted motorcycle was recovered in front of his house.

Contention on behalf of the petitioner is that informant was examined in course of trial but failed to identify the petitioner.

Petitioner carries criminal antecedent of four cases and the trial of the petitioner is in full swing and, therefore, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Araria P.S. Case No. 191 of 2015 pending in the court of Chief Judicial Magistrate

Patna High Court Cr.Misc. No.8188 of 2016 (2) dt.25-02-2016 2/2 (P-file), Araria stands rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within four months from the date of receipt/production of copy of this order, failing which the petitioner may renew his prayer for bail before the learned court below itself.
