Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 379/34 of the Indian Penal Code and Section 4 of the Bihar Minor Minerals Concessions Rules, 1972.

According to F.I.R., the petitioner and others were involved in illegal mining of sand. The F.I.R. reveals that the villagers had disclosed the name of the petitioner and others. The case diary would reveal that the witness Israel Dewan and others have stated that the petitioner was also involved in illegal mining of sand. Petitioner has got a long list of criminal antecedent.

Patna High Court CR. MISC. No.2029 of 2020(3) dt.16-06-2020 2/2 Learned counsel for the petitioner submits that some other co-accused have already been allowed anticipatory bail in this case as there was no direct material against them. Considering the material as disclosed above as well as criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Sahodara P.S. Case No. 30 of 2017.
