JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught by the police while he was unloading goods from pick-up-van.
Submission on behalf of the petitioner is that petitioner has a grocery shop and while he was unloading goods from vehicle , police made illegal demand, which was not fulfilled by the petitioner and that is the reason of the institution of the present case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Motihari, East Champaran, in connection with Chhatauni P.S.Case No. 180 of 2015/Tr. No.140 of 2015.
