The petitioner apprehends his arrest in Baheri P.S. Case No. 159 of 2019, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

Allegation against this petitioner is of commission of assault with rod on the head of brother of informant. It is submitted that petitioner has been falsely implicated in this case due to previous enmity, land dispute and village politics. Entire allegation is false and fabricated. No offence under Section 307 IPC is made out. There is case and counter case.

Learned APP however, vehemently opposed the prayer for bail and submitted that there is specific allegation

Patna High Court CR. MISC. No.7705 of 2023(2) dt.11-05-2023 2/2 against this petitioner that he assaulted by iron rod on the head of informant and petitioner has got two criminal antecedents. Considering the facts aforesaid and criminal antecedents, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the same is rejected.
