JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Although in first information report, the informant did not disclose the date of marriage but in course of investigation, it came to light that the marriage of the deceased had taken place one and a half years ago.

The deceased died other than normal circumstances and there is allegation against the petitioner, who happens to be husband of the deceased that he used to torture the deceased due to illegal demand.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail at least, at this stage and accordingly,

Patna High Court Cr.Misc. No.3388 of 2015 (3) dt.21-04-2015 2/2 prayer for bail of the petitioner in connection with Ishakchak P.S. Case No. 35 of 2012 pending in the court of Chief Judicial Magistrate, Bhagalpur/concerned court stands rejected. The learned Chief Judicial Magistrate, Bhagalpur is directed to commit the case of the petitioner to the court of Sessions in accordance with law within four weeks from the date of receipt/production of copy of order and after commitment, the concerned court should expedite the trial of the petitioner and try to conclude the same as early as possible.
