The petitioner apprehends his arrest in connection with Matihani P. S. Case No. 101 of 2016 instituted under Sections 366A/34 of the Indian Penal Code and Sections 8, 12 and 17 of the Protection of Children from Sexual Offences Act, 2012. The allegation, in brief, is that this petitioner enticed away 14 years minor daughter of the informant. Learned counsel for the petitioner submits that in fact the petitioner and the daughter of the informant were in love relationship and as per the statement of the girl recorded under Section 164 Cr.P.C., she voluntarily left the house along with the petitioner.

Since the daughter of the informant is only a 14- year

Patna High Court Cr.Misc. No.6591 of 2017 (3) dt.22-03-2017 2/2 minor girl, so prayer for anticipatory bail of the petitioner is rejected.

However, the petitioner, if so advised, may surrender and seek regular bail, which shall be disposed of on merit without being prejudiced by this order.
