The petitioner seeks regular bail in Kotwali P.S. Case No. 295 of 2014 registered under Section 304 and other sections of the Indian Penal Code.

The informant alleged that some people came and purchased Kajal from the father of the informant. On such, some dispute arose. On the order of Nandan Panda (the petitioner), Rajan Panda caught the father of the informant and Chotu Panda assaulted him with iron rod on his head.

Learned counsel for the petitioner submits that the occurrence took place in a spur of moment. The petitioner is only an order-giver. The petitioner is in jail since 22.10.2014. The police, after investigation, submitted chargesheet under Section 304 I.P.C. Chotu Panda is alleged to have given one

Patna High Court Cr.Misc. No.4335 of 2015 (2) dt.02-02-2015 2/2 blow with iron rod. There is no repetition of blow. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner has remained in jail for 3 months, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Kotwali P.S. Case No. 295 of 2014.
