JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Vakalatnama is filed on behalf of the informant. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he sold JCB to the informant with condition that the informant shall deposit the installments in the bank but subsequently, under some pretext, the petitioner took the aforesaid vehicle and got disappeared the same. The submission on behalf of the petitioner is that the informant himself got disappeared the vehicle so that he could escape from depositing the installments. Moreover, petitioner is in jail custody since 30.11.2015 and the investigation against the petitioner has been completed. It is admitted fact that the vehicle in question has not been recovered as yet.

No.7641 of 2016 (2) dt.18-02-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Brahampura P.S.Case No. 215 of 2015.
