JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but admittedly, the present case was lodged after recovery of corpus of deceased Tarni Ram as well as head of deceased Mantu Singh. The informant expressed her suspicion against petitioner no. 5 and others whereas mother of deceased Manto Singh expressed his suspicion against petitioner nos. 1 to 4 due to previous enmity. The investigation has already been completed but in course of investigation, not a single witness claimed to have seen the petitioners in the company of deceased persons prior to the
Patna High Court Cr.Misc. No.4732 of 2015 (3) dt.24-04-2015 2/2 alleged occurrence nor any prosecution witness claimed to have seen either actual killing of the deceased persons and disposing of their dead bodies.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Bihariganj P.S.case No. 108 of 2014.
