Petitioner is not name in the first information report and it appears from the impugned order that his name surfaced in this case in confessional statement of co-accused Rohit Kumar and after that, he was remanded in the present case. No doubt, petitioner carries criminal antecedent of some cases but in the present case, except the confessional statement of co-accused, there appears to be nothing against the petitioner.
