JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report with the accusation that they along with other accused assaulted the deceased and got admitted him in hospital but in course of his treatment deceased died.
Submission on behalf of the petitioners is that the informant is not an eye witness of the alleged occurrence and in course of investigation, not a single prosecution witness has come forward to claim himself to be an eye witness of the occurrence and moreover, co-accused Jagdeo Bhagat and Mohar Bhagat have already been granted privilege of bail by a co-ordinate Bench of
Patna High Court Cr.Misc. No.7892 of 2016 (2) dt.19-02-2016 2/2 this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Sahebganj P.S.case No. 238 of 2014.
