BAJANTHRI) 21-10-2024 The present Miscellaneous Jurisdiction Case is filed for restoration while recalling the order dated 04.07.2018 passed in L.P.A. No. 1140 of 2017 arising out of C.W.J.C. No. 19005 of 2013. Initially, at the time of filing Miscellaneous Jurisdiction Case No. 3796 of 2018, copy of the order dated 04.07.2018 passed in L.P.A. No. 1140 of 2017 arising out of C.W.J.C. No. 19005 of 2013 was not furnished, thereafter, it was furnished.
2. Taking note of reliefs sought in M.J.C.
Patna High Court MJC No.3796 of 2018(4) dt.21-10-2024 2/2 (Restoration), in the interest of litigant, we recall the order dated 04.07.2018 passed by a Coordinate Bench of this Court in L.P.A. No. 1140 of 2017 arising out of C.W.J.C. No. 19005 of 2013 while restoring L.P.A. No. 1140 of 2017 arising out of C.W.J.C. No. 19005 of 2013 to its original file number.
3. Registry is requested to list L.P.A. No. 1140 of 2017 arising out of C.W.J.C. No. 19005 of 2013 before the concerned Roster Bench at the earliest. The aforementioned order is subject to payment of cost of Rs. 3,000/-. Cost shall be paid by the appellant to the Patna High Court Legal Services Committee within a period of four weeks.
4. It is learnt that certain objections were still existing in L.P.A. No. 1140 of 2017 arising out of C.W.J.C. No. 19005 of 2013, in that regard, the concerned Roster Bench of L.P.A. will examine and grant sufficient time for compliance of office objections.
