The petitioners apprehend their arrest in Turkauliya P.S. Case No. 232 of 2021 registered for the offences punishable under Sections 341, 504, 323, 307, 427, 506 and 34 of the Indian Penal Code and Section 45 of the Bihar Prohibition and Excise Act, 2018, later on Section 353 of the I.P.C. was added, pending in the Court of learned Additional Sessions Judge-2ndcum-Special Judge Excise, East Champaran, Motihari. Learned counsel for the petitioners seeks permission to withdraw this application with respect to petitioner no. 2 submitting that during pendency of this

Patna High Court CR. MISC. No.3942 of 2023(3) dt.04-05-2023 2/2 application the petitioner no. 2 has already been apprehended by the police.

Permission is granted.

Accordingly, this application with respect to petitioner no. 2 is dismissed as withdrawn.

Now, this application is being heard only with regard to petitioner no. 1.

Heard learned counsel for the petitioner and learned APP for the State.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
