JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This application, for grant of anticipatory bail, arises out of Charpokhari P.S. Case No. 32 of 2019, disclosing offences under Sections 341, 323, 504, 506, 308, 379 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant and others.

Submission of learned counsel for the petitioners is that only general and omnibus allegation of assault has been levelled against the petitioners and injuries sustained by the injured were found simple in nature. Considering the same, a coordinate Bench of this court has granted the privilege of anticipatory bail to other accused persons vide order dated

Patna High Court CR. MISC. No.3565 of 2020(2) dt.21-01-2020 2/2 01.08.2019 passed in Cr. Misc. No. 47939 of 2019. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 32 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that if the injury sustained by the injured was found grievous in nature, the prosecution will be at liberty to move for cancellation of bail bond of the petitioner.
