No doubt, earlier prayer for bail of the petitioner was rejected by this court taking note of the allegation levelled against him but in course of trial neither the victim nor the informant has supported the prosecution case.

Considering the above stated changed circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge (POSCO), Muzaffarpur in Sessions Trial no. 4/2014 arising out of Siwaipati P.S. Case no. 15/2014.
