Petitioner is said to have opened fire but according to the prosecution case itself, aforesaid firing did not hit anyone. So far as recovery of firearm is concerned, the same is recovered by a private person.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Narpatganj P.S. Case no. 430/2015.
